BEND, OR -- A decision by Deschutes County Commissioners to deny a marijuana production facility has been overturned by LUBA, the Land Use Board of Appeals. This means the decision is going back before the county, which ruled the facility would be too close to nearby youth-oriented activities. The facility was planned for a site on Dodds Road. But LUBA ruled the decision that referred to "youth activity centers," is a term not defined in county code. LUBA agreed with the business that the county’s broad interpretation of youth activity centers is unreasonable.
