(Seattle, WA) -- A man who stayed atop an 80-foot Sequoia tree outside the Macy's in downtown Seattle will remain under mental evaluation after being ruled incompetent to stand trial. The "Seattle Times" reports 29-year-old Cody Lee Miller is facing charges of malicious mischief and assault after being accused of throwing green seed cones, branches and metal objects during a standoff with police and firefighters while perched in the tree in March. Miller will undergo a 45-day competency-restoration period to see if he responds to medication.
